Tort Liability in an Age of Driverless Cars

All signs indicate that autonomous vehicles will be safer than human-driven cars. A law and economics analysis tells us that individual consumers might thus one day be held negligent for driving their own vehicles rather than using self-driving cars. This leaves us with concerns about how tort law might be wielded to ignore people’s preferences and exacerbate distributional inequalities in the allocation of safety.
